Andy Blueman Nyctalopia song = a copy of someone else's work??
or the other way around? I'd like to think that it was written by andy and Oblaid just used it with permission...

I know it that sometimes (rarely) 2 people come up with the same melody independently. afterall, no melody is probably truly original...but these are both 2 uplifting trance tracks... how can this sound the same? There is like a single note change in the melody. |

Andy Blueman <3 is 2007. Oblaid is 2012. It's extremely unlikely Oblaid created the track 2007 or earlier and did not get it signed. Also, it's 100% Andy Blueman style.

Oh, and you did the right thing. Do not feel bad. A few of us on TC are loyal Blueman fanboys. If it's without permission and Andrej and record label can have it removed, then good. Even better if they can get compensation (should it be copyright infringement).

I've done a little more digging. Apparently it's a duo between two people who are either Mexicans and/or residing in Mexico: Oblaid* & Albert Van Leizer.

this is what the label has to say:
Aaron Waters I am the lead owner of Fuzion Four Records and I had no idea this was even remotely close to anything else, from what I could tell from vetting Albert Van Leizer aka Alpha Force he was a legit producer with no history of ripping off tracks, this will be taken care of and I will be willing to talk with Andy to work this out, for those of you who want to blame the label for this, please stop, there are literally millions of dance songs in the market, do you actually expect a label to surf the net to see if a song sounds the same as another? That's like finding a needle in a hay stack, we have not and will not ever intentionally sign something we think has been ripped off from another producer, we condemn those actions and will not tolerate such dishonest, reprehensible behavior. True producers like Andy deserve their art to be protected and for any so called producer to rip him off they should be blacklisted from the industry, it is appalling, however, it is my duty to investigate this issue and get to the bottom of it and make things right. As much as I hate what happened I also hate it when people want to blame a label right off the bat for the misconduct if they were lied to, for you to bad mouth us is to hurt our business and we do not need this. It's also even more sad that the guy who copied Andy's work is on his msn friend's list and andy has helped the guy before when he asked questions about producing.................. |

Sometimes it's just inevitable that tracks sounds similar.
But in this case the melody is clearly stolen. It would've been so much easier for all parts if he named it Nyctalopia cover or something and give credits to Andrej. This is just legally and morally wrong. |

Yeah probably. And also producers get inspiration from other producers and tracks.
But if a producer copies an already released track, then the producer shouldn't claim it to be his own. He should just keep it on his hdd. But I must also point out that it's dreary for producers who made a tune out of his own creativity and mind, and hear others saying it is a copied track when it's not. |

Happened before with one of the admins from TranceFamily. I think he blatantly copied tracks from unknown artists which he found on soundcloud and signed them to various labels. But this is something else. Nyctaplopia is a well known track, not only is it wrong but it's stupid of him too.

That is disgraceful, you can hear the note changes where it sounds like deliberate alteration of the original melody to appear different.
Awful production too, im glad andy has found out about this and i hope the munch-hole who ripped it off never sees another label release again! |
